How to interpret the exclusion of transportable pressure equipment "used exclusively for the transport of dangerous goods between Community territory and third country territory" given in Article 1, paragraph 4?

Does the TPED also cover "gas cartridges" (UN 2037)?

 

 

Concerning the Commission Decision 2003/525/EC of 18 July 2003 deferring for certain transportable pressure equipment the date of implementation of Council Directive 1999/36/EC, which exactly are the dates referred to in Article 2? "Member States shall authorise the placing on the market and putting into service of the equipment referred to in article 1 which complies with the regulations in force within their territory before 1 July 2005 until 24 months from that date and shall authorise the subsequent putting into service of such equipment placed on the market prior to that date."

 

 

After the transitional arrangements (Article 18 of the TPED), will it be possible to carry transportable pressure receptacles without pi-mark and approved according to the RID/ADR by a Member State (of the European Union), for the transport of dangerous goods within the Community territory?

Are open (non-closed) cryogenic receptacles used for the transport of refrigerated liquefied gases within the scope of the TPED?

 

 

According to 4.1.3.6 of RID/ADR, gas receptacles conforming to packing instruction P200 and to the construction requirements of Chapter 6.2 are authorized for the carriage of other substances than Class 2 or those covered by  marked transportable pressure receptacle be used forpannex VI of TPED. May a  such a carriage?

 

Implementation

 

 

Where EN standards for cylinders, tubes and cryogenic receptacles are not listed in 6.2.2 of RID/ADR;
1) May a technical code be used? and
2) The equipment pi-marked?

 

 

The joint meeting has approved the reference to some EN standards for the construction of cylinders (e.g. EN 1442, EN 1964-1). The revised editions of the RID/ADR including those references are in force from 1 July 2001. May the cylinders manufactured before 1 July 2001 according to those standards be pi-marked and if not, would they need to be reassessed by a notified body? If yes, can a simplified method of revaluation be used (e.g. visual inspection)?

 

Conformity assessment

Is it possible to transform a type approval obtained in accordance with national regulation into an EC type-examination without any further tests?

 

 

Shall the written declaration of conformity contain the same information as given in Annex VII to PED?

 

 

Acetylene cylinders need to be inspected after massing (RID/ADR 6.2.1.5.1(i)).  Shall this inspection be performed by a body notified under the TPED?

 

 

Under what circumstances can a Competent Authority recognise a technical code to which pressure receptacles in scope of TPED may be built?

 

 

Where transportable pressure receptacles within scope of TPED, are constructed to a technical code recognised by a Competent Authority in accordance with Guideline TPED 34 should:
1. the technical code be recognised through a formal document?
2. other Competent Authorities be informed of its recognition? and
3. it contain requirements that are not in compliance with the requirements of RID/ADR?

 

 

How can a manufacturer of transportable pressure equipment with relatively small wall thickness (less than 5 mm) demonstrate (as defined in Article 7, para.2. of TPED) to a Member State in which the ambient temperature is regularly lower than –20ºC that the most stringent standards for material properties as regards the lower operating temperature are fulfilled.

 

Conformity reassessment

May existing cylinders produced outside the EU be reassessed to be in conformity with the TPED and be pi-marked?

 

 

What is the conformity reassessment procedure for transportable pressure equipment that is designed, manufactured and put in service in accordance with a technical code recognised by a competent authority which is identical to a standard that is referenced later in RID/ADR?

 

 

a) Is it possible to time dissociate the type conformity reassessment and the pi-marking?
b) For the pi-marking, is it possible to apply to a body different from that which reassessed the type conformity?

 

 

Is it possible, for transportable pressure equipment which conform to one national regulation, to reassess, on the basis of documents, all the equipment being of the same type and which conform to this regulation?

 

 

1. For existing pressure receptacles subjected to a conformity reassessment, do the markings have to be in conformity with the requirements of RID/ADR applicable for new receptacles at the time of the reassessment?
2. Shall the missing markings be added? 

 

Periodic inspections and repeated use

Is there a reassessment of conformity necessary for cylinders built according to the directives 84/525-526-527/EEC that are placed on the market before 1 July 2001 or within two years after that date?

What does the periodic inspection for valves and other accessories used for transport consist of?

 

 

May the identification number, that has been assigned by the Commission to an notified body or approved body replace the identity mark or stamp of the inspection body as identified in:
6.2.1.7.1c) of ADR/RID regarding initial inspection and test.
6.2.1.7.6 of ADR/RID regarding periodic inspection and test

 

 

Is the periodic (annual) technical inspection of the vehicle as laid out in chapter 9.1 of the ADR included in the scope of the TPED? In other words, may the validity of the certificate of approval of vehicles be extended by any of the EU members?

 

 

One of the conditions of use and maintenance ensuring the continued conformity of transportable pressure equipment is that these equipment be "filled in appropriate filling centres".
What is an "appropriate filling centre"?

 

 

May operations of periodic inspections of receptacles be carried out by filling centers?

Article 4, paragraph 3 of Directive 1999/36/EC indicates that "The approved body shall work exclusively for the group of which it is member". What is a group?

 

 

Is a notified or approved body that meets the requirements of the TPED automatically an inspection body for UN pressure receptacles of ADR/RID and vice versa?

 

Pi-marking equipment

 

 

May the cylinders built according to the directives 84/525-526-527/EEC and placed on the market before 1 July 2001 or within two years after that date be stampmarked with the indication "- 40°C" showing compliance with the requirements of Article 7.2 without a reassessment of conformity?

 

 

The identification number of the notified/approved body will be a 4-digit number and will be very similar to the test date in month/year. To avoid confusion by the packer/loader about the exact next retest date, is it allowed to put the identification number in a circle or a square?

 

 

What is the relation of the p marked pressure receptacles to the UN marked pressure receptacles according to RID/ADR 2003?

 

 

At what stages shall the pi-marking and the markings related to acetylene service of an acetylene cylinder be placed?

 

 

What is the procedure when a gas cylinder with a UN marking is first taken into use within the EU?

 

 

Can a spherical receptacle be considered as a pressure drum?

 

 

A bundle of cylinders is an assembly of cylinders, fitted or not with individual valves, inter-connected by a manifold and secured in a metallic frame. In many cases, the assembly is made by the owner of the bundles or his authorised representative.

 

Pi-marking accessoires

 

 

When a gas producer fits a new valve pi-marked (or CE marked) on a new cylinder pi-marked as well, does the producer need to have the assembly subjected to a global conformity assessment as it would be required under the PED?

 

 

Shall the service equipment of tanks – such as pumps, metering devices, filling/discharge hoses - be pi-marked, CE marked or not marked at all?

 

 

Is a valve cap an accessory in the scope of the TPED and does it require the pi-mark?

 

 

According to Article 1.2.c) and to Article 10.3., gas cylinders covered by Directives 84/525;-526;-527/EEC shall be pi-marked at the next periodic inspection. Does it mean that consequently, when those cylinders are pi-marked, they can only be transported when equipped with pi-marked safety accessories?

 

 

What are the requirements for the marking of existing valves and other accessories having a direct safety function when they are reassessed?

 

 

Where valves or other accessories having a direct safety function which are not designed and constructed in accordance with the standards listed in 6.2.2 of ADR should they be designed and constructed to a technical code recognised by the Competent Authority.

a) portable fire extinguishers;
b) "cartridges" for the pressurisation of fire extinguishers;
